Legal status of family members of Union citizens in the light of European law

The objective of this thesis is to analyse the issues related to the legal status of family members of European Union citizens in light of European Union law, and to compare the rights of family members of EU citizens with the rights of the other third country nationals (further referred to as TCNs) and the EU citizens themselves. The first chapter deals with the institute of EU citizenship and especially stresses the importance of the right of EU citizens and their family members to move and reside freely within the territory of Member States which is connected with the status of an EU citizen. The second chapter is related to the different definitions of family members in EU secondary legislation. The third chapter examines in detail specific rights (e.g.: the right of entry and residence to the territory of the host Member State, protection against expulsion) which are connected with the status of the family member of EU citizens on the one hand and the status of the TCNs on the other hand. The thesis attempts to answer to the questions related to the legal status of family members and tries to suggest possible future adjustments of EU legislature.

Third country migrants family reunification

This thesis deals with the topic of family reunification of third countries immigrants. Whole work is focused mainly on families with all family members coming from non-EU country. Rights and obligations of this group are highly influenced by the EU directive on family reunification 2003/86/ES, implemented into Czech law in 2005. Second group, which is discussed in the work, are families with one member being Czech or EU national and the other family members from non-EU countries. This work examines current legislative, which influences family reunification and examines its consequences on immigrants experience through the whole reunification process and their life - based on semi structured interviews. The main aim of this work is to explain current family reunification legislative and its development, using policy documents, stenographic protocols from debates of members of the legislature or election programs
The United Nation Convention on the Rights of the Child in the case of refugee children

This Bachelor thesis addresses the issue of the basic human rights of Refugee Children guaranteed to every child by UN Convention on the Rights of the Child adopted in 1989. The thesis describes the processes and situations in which a Refugee Child who is accompanied by family members or who is an Unaccompanied Minor goes through during the proceeding of International Protection in the European countries. The thesis focuses only on the articles of Convention that are applicable to crucial problems in the current situation of Refugee Children.
The Shift in Canadian Immigration policy under the Conservative government of Stephen Harper

In this bachelor thesis, titled "The Shift in Canadian Immigration policy under the Conservative government of Stephen Harper", are introduced and subsequently analyzed changes in the immigration policy of Canada that have been made under the government of conservative Prime Minister Stephen Harper (2006-2015). The aim of this work is to point out a fundamental change in the nature of immigration policy of Canada. The thesis of the work is: "Canada abandons the search for the perfect citizen and focuses on selecting an ideal worker." The first chapter of the thesis is a historical overview, which explains the role of immigration in Canadian society and major milestones in Canadian immigration policies before the Harper government. It also notes the most significant problems and challenges in this field Canada faced and were one of the causes of the current reform of the immigration system. A key part of the thesis is the second chapter, which analyzes the different changes in immigration policy, which took place under the government of Stephen Harper. Through entire chapter is demonstrated how the individual changes will transform the nature of Canadian immigration policy. The last chapter of this work analyzes the impact of implementing reforms to Canada's immigration system and society.
Czech migration law within the context of EU law

The goal of this diploma thesis is to define, analyze and evaluate the most relevant areas related to the topic of European migration law and politics. Although the subject is quite broad, I try to focus on legal migration. Free movement of EU citizens could not be left out, however I concentrate mainly on position of migrating three country nationals within the EU. I compare the Czech legal system against the European legal system. The thesis has been divided into four chapters, which are further subdivided. In the first chapter the thesis brings a brief definition of the concept of migration in general, including a chronological historical excursion of the European norms connected to the migration law and a description of migration law, politics and the necessity of a suitable integration approach. The second chapter is devoted to create a characterization of the European migration legislation, competences in the field and a definition of fundamental human rights standards. This section also deals with theoretical and practical issues of European citizenship and the associated right of free movement. Turkish Immigration in France in the Context of French Immigration Policy

The thesis Turkish Immigration in France in the Context of French Immigration Policy analyses the influx of Turkish immigration into the French state. It covers the period from the 1960s to the present. In the 1960s immigrants from Turkey started entering France as guest workers and after a while they were joined by chain immigrants and asylum seekers. All the stages of immigration are discussed in the text one by one and they are examined as a phenomenon that has been heavily influenced by French immigration policy. The rate and form of the influence of French immigration policy constitutes the main aim of the paper. It also introduces the conditions in Turkey that have led people to emigrate. The paper addresses the common linkages between each stage in the immigration process and the subsequent development from one stage into the next. It is argued that such an interconnection limits the influence of French immigration policy to significantly reduce, or even halt, the immigration process. On the other hand where it does not influence the amount of immigrants in total, it affects immigration in the way immigrants from Turkey enter France. The legal status of third-country nationals in the EU

This thesis deals with the legal status of third country nationals in the EU. It focuses on the legal status of long-term residents and the right to family reunification. Particular parts of the thesis analyze these topics in relation to European law, discuss the rights and obligations of third-country nationals, which are contained in the relevant directives, and assess the impact of these directives. The last part is concerned with the issue of foreigners in the Czech Republic, it solves the matter of residency rights of foreigners and implementation of directives on the long-term residents status and the right to family reunification in the Czech legal order.
